Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Dangerous by Design program ("Program") offered by Neur Culture, operated by Guillermo Quirindongo ("we," "us," or "our") at dbd.neurculture.com. By purchasing or accessing the Program, you agree to be bound by these Terms. If you do not agree, do not access or use the Program.
1. The Program
Dangerous by Design is a five-day digital business-building sprint designed to help founders, creators, and skilled professionals produce a tangible business asset using AI tools. The Program consists of daily instructional content, structured prompts, access to a custom AI companion (Vero), and a results wall for proof submissions.
Access to the Program is granted upon successful payment of the one-time fee of $47 (USD) or such other price as displayed at checkout. Payment is processed by Stripe. You must be at least 18 years of age to purchase or access the Program.
2. Access and License
Upon purchase, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Program for your personal, non-commercial use. This license does not include the right to:
- Share, resell, sublicense, or distribute access to the Program or its contents
- Reproduce, copy, or republish Program materials in any format without written permission
- Use Program content to create competing products or services
- Provide access credentials to third parties
We reserve the right to revoke access for any violation of these Terms without refund.
3. Intellectual Property
All content within the Program, including but not limited to text, copy, structure, prompts, frameworks, branding, and design, is the intellectual property of Neur Culture and Guillermo Quirindongo. Nothing in these Terms transfers any intellectual property rights to you.
Content you create using the Program, including your written assets, proof submissions, and any business materials you produce, belongs to you. By submitting proof to the results wall, you grant us a non-exclusive, royalty-free license to display that submission within the Program for the duration of the cohort.
4. Refund Policy
Due to the digital nature of this Program and the immediate access granted upon purchase, all sales are final. We do not offer refunds except where required by applicable law. If you experience a technical issue that prevents you from accessing the Program, contact us at legacy@neurculture.com and we will work to resolve it.
Chargebacks initiated without first contacting us will be disputed and may result in permanent removal from the Program and any future Neur Culture offerings.
5. No Guarantee of Results
The Program provides education, frameworks, and AI-assisted tools to help you build a business asset. We make no guarantee that participation in the Program will result in any specific financial outcome, business result, or level of success. Results depend entirely on your effort, implementation, existing skills, market conditions, and factors outside our control.
Testimonials and proof submissions displayed within the Program reflect individual experiences and are not representative of typical outcomes. Your results will vary.
Nothing in this Program constitutes legal, financial, tax, or professional business advice. You are solely responsible for decisions made in your business.
6. Third-Party Tools
The Program directs you to use third-party tools including OpenAI's GPT platform (Vero), Kit (ConvertKit) for email marketing, and Stripe for payment. Your use of these tools is governed by their respective terms of service and privacy policies. We are not responsible for the availability, performance, or practices of any third-party tool.
We are not affiliated with, endorsed by, or sponsored by OpenAI, Kit, Stripe, Meta, TikTok, X, or any other third-party platform referenced in the Program.
7. Advertising
We may run paid advertising on platforms including Meta (Instagram and Facebook), TikTok, X (Twitter), Google, and others. These advertisements may be targeted using data collected in accordance with our Privacy Policy. Advertising content is clearly distinguishable from organic content where required by applicable law and platform policies.
Any claims made in advertising are subject to substantiation and comply with applicable Federal Trade Commission (FTC) guidelines and equivalent regulations in other jurisdictions.
8. User Conduct
You agree not to use the Program to:
- Violate any applicable law or regulation
- Harass, threaten, or harm other participants
- Post spam, misleading content, or content that infringes third-party rights to the results wall
- Attempt to gain unauthorized access to any part of the Program or its infrastructure
- Reverse engineer, scrape, or extract Program content in bulk
We reserve the right to remove any content from the results wall and terminate any access that violates these Terms.
9. Disclaimer of Warranties
The Program is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Program will be uninterrupted, error-free, or free of viruses or other harmful components.
10. Limitation of Liability
To the maximum extent permitted by law, Neur Culture and Guillermo Quirindongo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Program. Our total liability for any claim arising from the Program shall not exceed the amount you paid for access.
11. Indemnification
You agree to indemnify, defend, and hold harmless Neur Culture, Guillermo Quirindongo, and their respective affiliates from any claims, damages, losses, or expenses arising from your use of the Program, your violation of these Terms, or your violation of any third-party rights.
12. Governing Law
These Terms are governed by the laws of the State of Maryland, United States, without regard to conflict of law principles. Any dispute arising from these Terms or the Program shall be resolved in the courts of Maryland, and you consent to personal jurisdiction in that venue.
13. Dispute Resolution
Before initiating any formal legal action, you agree to contact us at legacy@neurculture.com to attempt to resolve the dispute informally. We will respond within 30 days. If informal resolution is not possible, disputes may be submitted to binding arbitration under the rules of the American Arbitration Association, except where prohibited by law.
14. Modifications
We reserve the right to modify these Terms at any time. Updated Terms will be posted at this URL with a new effective date. Continued access to the Program after modifications constitutes acceptance of the updated Terms.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Neur Culture regarding the Program and supersede any prior agreements.
